Building Trades Win Big in 2025

Genium and Michael Cinquanti wrapped up an extremely successful 2025 legislative session for the New York State Building Trades.  In addition to various wins in the State Budget related to infrastructure funding, procurement reform and training funds, the Trades prioritized many bills that were passed by the Legislature and eventually signed into law.   We led on many of these and negotiated chapter amendments that will be finalized in January 2026.  Check out the full list:

Offsite Fabrication (S2536A Jackson/A2747A Bronson)

Ensures that custom fabrication performed offsite is subject to prevailing wage requirements, including maintaining certified payroll and contractor registry.  The new law will apply to offsite work, regardless of jurisdiction, and includes transparency and reporting requirements to DOL.  Effective summer 2026, depending on timing of final agreed to chapter amendment being passed and signed in January.

Construction Paid Family Leave (A4727 Bronson/S50 Comrie)

This bill would ensure paid family leave benefits for individuals subject to a collective bargaining agreement and working for multiple employers in the field of construction. Clarifies construction workers are eligible for benefits by working at least 26 of the last 39 weeks subject to a CBA, regardless of the employer. This legislation will become effective in 2027.

Apprenticeships on Clean Energy Projects (A2730A Barrett/S4881A Scarcella-Spanton)

Expands apprenticeship requirements to all clean energy projects under §224-d of the labor law, including solar and wind.  Effective September 2026 subject to chapter amendment.

Mechanical Insulation (S2457B Ramos/A3999B Bronson)

Directs NYSERDA to establish an incentives program to allow public schools receive incentives for mechanical insulation upgrades and installations.  May be expanded to housing and hospitals.  All work would have to be performed by contractors with apprenticeship agreements and subject to prevailing wage requirements.  Effective in 2026 subject to chapter amendment.

Prevailing Wage on Hauling of Concrete/Asphalt (A8465 Otis/S7485 Mayer)

This bill clarifies that prevailing wage be applied to the hauling and delivery of concrete and asphalt on §220 public work projects in NYC and counties of Nassau, Suffolk, Westchester and Putnam. Effective immediately.

Design-Build-Westchester County Projects (S8394 Stewart-Cousins/A6428A Shimsky)

This bill allows the Westchester County Department of Public Works and the Westchester County Department of Transportation to use design-build contracts for four projects. Project labor agreements and public employee protections will apply.  Effective immediately.
